1 Applicability to entrepreneurs and definitions of terms

(1) The following general terms and conditions apply to all deliveries between us and a consumer in the version valid at the time of the order.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.

2 Formation of a contract, storage of the contract text

(3) The presentation of the goods in our online shop does not represent a legally binding contract offer on our part, but is only a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer makes a binding offer to conclude a purchase contract.

(4) When an order is received in our online shop, the following regulations apply: The consumer submits a binding contract offer by successfully going through the ordering procedure provided in our online shop.

The order is made in the following steps:

1. Selection of the desired goods
2. Confirm by clicking on the “Add to shopping cart” button and then “Checkout” in the shopping cart or “Buy now” directly.
3. Checking the information in the shopping cart.
4. Entering the purchase, buyer and shipping information or express checkout via third-party providers (e.g. Google Pay, Apple Pay, PayPal or Shopify Pay).
5. Binding dispatch of the order by confirmation, depending on the selected payment method, "Order with costs", "Buy now", "Conclude purchase", "Pay now".

Before the binding dispatch of the order, the consumer can correct the recorded buyer data or cancel the order process at any time by closing the Internet browser. We will confirm receipt of the order within a few minutes with an automatically generated e-mail, with which the purchase contract is concluded.

(5) Storage of the text of the contract for orders via our online shop: We will send you the order data and a link to the terms and conditions by e-mail. You can also view the terms and conditions at any time at https://march.care/pages/business-conditions. For security reasons, your order data is no longer accessible via the Internet.

3 Prices, shipping costs, payment, due date

(1) The prices indicated include the statutory sales tax and other price components. In addition, there are any shipping costs.

(2) The consumer has the option of paying by direct debit, PayPal, credit card (Visa, Mastercard) or Klarna.

4 delivery

(1) Unless we have clearly stated otherwise in the product description, all items we offer are ready for dispatch immediately. The delivery takes place within 7 working days at the latest. In the case of payment in advance, the period for delivery begins on the day after the payment order to the bank commissioned with the transfer and for all other payment methods on the day after the conclusion of the contract. If the deadline falls on a Saturday, Sunday or public holiday at the place of delivery, the deadline ends on the next working day.

(2) The risk of accidental loss and accidental deterioration of the item sold is only transferred to the buyer when the item is handed over to the buyer, even in the case of mail-order sales.

5 Retention of Title

We reserve ownership of the goods until the purchase price has been paid in full.

6 Right of withdrawal of the customer as a consumer

Consumers are entitled to a right of revocation, whereby a consumer is any natural person who concludes a legal transaction for purposes that can predominantly neither be attributed to their commercial nor their self-employed professional activity.

Right of withdrawal

Consumers have the right to revoke the concluded purchase contract within 14 days without giving reasons. The cancellation period is 14 days from the day on which the recipient of the order took possession of the goods.

To exercise the right of withdrawal, it is sufficient to send us a written declaration by post or e-mail informing us of the withdrawal from the contract by post to MARCHCARE Naturkosmetik Handels GmbH, Göttelsberg 278, A-8160 Mortantsch or electronically to hello@march.care.

Consequences of revocation

If you withdraw from the purchase contract, we shall refund all payments that we have received from you, including the standard delivery costs, to the buyer immediately and at the latest within 14 days from the day on which we received notification of your cancellation of this contract. For this repayment we use the same means of payment that you used when ordering. We can refuse the repayment until we have received the goods back.

In the event of cancellation, you must return the delivered goods to us immediately, but no later than 14 days after you have informed us of the cancellation of the contract. You bear all costs of returning the goods.

7 Warranty

The statutory warranty regulations apply.
